Funny thing really the law an all, in England the law for skate boards is the same as for bikes, the bike law dosent specify number of wheels just that its powered by you. It also dosent specify braking as needing equip.. you can do that braking yourself. The law specifies lights at night, no safty gear needed and your not allowed on the pavement/sidewalk just the road.
I've been stopped by coppers before and they've had not a leg to stand on. Unless your committing crimes like disturbing peace/ destruction of property etc your fine.. Remember if you think like a bike your fine in blighty... oh and speed limits apply =)

Eddie Texas Outlaw: Every jurisdiction has a schedule they follow regarding transfer of ownership of the road for a development. Most likely the road will become property of the municipality governing the area. It used to be common that you owned the section of street in front of your house the width of your property to the center of the street, etc., but I doubt that is still happening. Maybe it still does in good ol' Texas. In an event like this the municipality still has an easement on the property but you have greater rights in regard to some *sshole that wants to set up camp on your property (the road easement). So, anyway, the ownership to the road in question should transfer soon and there shouldn't be an issue after that (Except for the cones). The plumbing department usually names the streets because they are usually the first municipal agency to start work on an area. Everyone should be aware of the ownership status of where they are skating. Otherwise you will wind up letting someone bully you off of a skating area with threats of trespassing charges that could never be validated by a court. I once had a guy whip out a badge and try to intimidate me out of an area, I was too far away to see what agency the badge represented but it looked to be either fire inspector or sanitation inspector so I called him on it. I yelled, "What's that? Sanitation Department?" and he sauntered away with the woman who had requested that he intimidate me away from the area. Status, jurisdiction, and ownership are nine tenths of the trespassing issue. Know them and the game is all yours. Rip a big Bertleman for me...

I took off early this morning to slalom about an hour away from my home at a new subdivision, it has a nice hill at the entrance and a steep hill at the top. Speed about 20-25 mph I have been slaloming there for weeks, even the cops have stopped and talked with me regarding the aspect of downhill slalom. After 2 hours of shooting through cones a black Lexus pulled up and a gentlemen told me he was the owner of the subdivision and that I couldn't skateboard there. I apologized, the gentlemen replied "you are not sorry , the only thing you are sorry of is that you got caught". The gentlemen was with his family and I did not want to come across as a disrespectful bumb. I told him I would leave his subdivision and would not tress pass again. Interesting people were riding bikes there and jogging. But I was the only one who was not welcome. I will continue to look for some hills. Eddy Texas Outlaw.

Most skateboarding law comes down to judging how safe it is. If you can take it to court and demonstrate how safe you were being.
For me, this particular code makes luging illeagal in Alameda County. I am looking into finding information regarding the creation of this ordinance. Good luck to you.

Mike P.: The first thing you need to do is go to the risk management office of the department in question and file a "lis pendens". The courts have held time and time again that government agents are not responsible for "errors", "mistakes" or other reasons that your property was lost, stolen, purposely destroyed, etc. provided that they were operating in a "reasonable" manner. Once the lis pendens has been filed the police can no longer claim that they did not know that you wished to have your property returned and cannot sell, destroy, etc. until there is an order of the court. I think it was Madison that said that if executive, legislative and judicial functions were all contained in one body that this in itself was the definition of tyranny. Petty cases such as this show clearly the property rights issue and the glaring reality of the court/police you scratch my back I'll rub your front mentality that is endemic in government. We probably still have the best government on the planet so I don't necessarily want to advocate revolution but the endemic nature of the type of abuse you suffered is not going to go away until the cop is scared to do so.

Yep. They all seem to abuse that power if they are bored. I guess its a matter of feeling useless. No crime to fight and then also not wanting to fall into the stereotype of the cop waiting at the doughnut shop for somethin to go down. Now they just eat the doughnuts incognito in the cruiser...cruisin lookin for someone to harass, the funnyest part... they get payed from tax money that we give, so we are paying to get messed with. what a joke.

No, I didn't run from the cops, in fact as soon as the sirens went off I came to a stop with a nice clean slide. As I was being lectured, the cop made a couple of interesting points; 1) that I shouldn't skate because there's no reliable way to stop 2) That when I stopped I quote "almost went under the front of the cruiser" (which seems to say that I do in fact have a reliable way to stop) and 3) that the car trailing me wasn't for protection (as I had tol him it was) but was to block off cops. If I almost went under the front of his car, that seems like a good reason to me to have a friend who knows that I can stop behind me. All of his points seemed to contradict each other.
Anyway... Yeah I live in a town called Piedmont in California. Its surrounded by Oakland, next door to Berkeley and drastically different from the 2. There is a cop for every resident, and the only crime in the town is vandelism, and of course me riding down the street with the flow of traffic at my own risk, but of course, that's illegal. In terms of getting my equipment back, I'm trying to clear the charges by kissing ass first. I actually have decided not to skate in this town anymore. I'll just go to Oakland or Berkeley to skate, where the cops have real crime to deal with, and don't give a s#@! if I wanna risk my safety for the sport I love (also the cop laughed when I called it a sport. I wanted to knee him in the balls.) After I try to clear my name, I'll fight like a "Bengelled Tiger" to get that stuff back, and also to change these stupid ass laws.
(Little Californian humor there.)

I say that you call the police station every day and ride them about the skateboard they stole from you. That lets them know that if those oinkers give it to one of their kids for a birthday present, you'll notice. Also, save your receipt showing the date of purchase so if they ruin it you can demonstrate how it was not ruined when they stole it.

hey mike, where do you live? i've gotten a few very stern talking to by some not so nice cops, but never have heard of people being arrested for bombing hills. i assume you did'nt try to run from the cops, cus thats a whole different story. as with bikes, that annoys the hell out of me. i've ridden hills where cops tell me to stop skating cus its not safe when i'm in my full face helmet, full leathers and gloves while bikers are allowed to bomb the hill with nothing but some spandex on. from what i know, skateboards are considered "pedestrians" and bikes are not. and "pedestrians" are not allowed on a road. but of course, not all pedestrians can go 50 mph.....the laws are whack. can't i be allowed to hurt myself all i want? at least i've having fun while doing it..
oh yea, thats super lame they took your comet speedboard, those are some of the best out there!

After an incedent last night that left me without a board, i decided to check out some of the oppinions on this site regarding the law. I tend to agree with most people in that if you're causing a problem, and get kicked out its best to just leave and be polite. Often the cops, rent-a-cops, techers, residents etc. are just enforcing laws that they may or may not agree with. When someone comes to me and just says; you gotta get outa here, i usually just say ok and go. My arguments start when people try to explain why i have no right to skate. I've heard it all, and im sure you all have too, but i ussually get in arguments when this happens.
Last night i was skating with my full face helmit, light, and friend in a car behind me down a street near my house and when i was goin about 40, i hear the buzz of a siren and see the red/blue on the gorund. I got taken arrrested, taken in finger printed, the works, and they took my brand new comet speedboard as evidence along with my gloves and helmit.
As I rode down, i rode alongside a biker with neither a helmit, nor a light, who was cheering me on, like the cool ones do. My question is why is it legal for that guy to go down the street, but not me. Has anyone tried to change these ridiculous laws? I'm sure as hell going to, and if you have any tips or anything to help me, please let me know. The bulls#@! laws have gone on long enough. Where are our rights?

David, There are lots of hill in Washington for bombmin to higher speeds and both sweeping and technical corners. you just gotta know where to look. Alot are short and steep .5m to a mile but there are a some that are 2 miles long or more. look to the mountains and dropping into valleys. and just to stay with the thread...Most are on public roads so it not legal

so how fast can you go when bombing that hill from top to bottom? i'm in olympia, not much hills to skate, considering i've been spoiled rotten by living in the bay area and skating the berkeley hills on a daily basis.

Almost true -- it's better than that. The upper road at Mt Tabor park (in Portland Oregon) is closed to traffic all the time. It is normal to see lots of longboard, downhill, and slalom on this hill in the summer. On Wed evenings, the entire road top-to-bottom is closed to traffic. Then the serious downhill bombers come out.

Yes they definatly do call..I had some friend of mine get pulled over after a night of bombing and the officer told them that someone called because there were some "Extreme Skateboarders" racing in the neiborhood. When in fact we were just carvin it up and shootin the hill. Almost every time I skate a few runs I will see a police man creepin around these parts. I live in a rapidly growning suburb of seattle with almost no crime really but so many new cops on the force they gotta fill there time with something, like protecting me from myself I guess. On that note we have a new law you are required to wear a helmet when you ride a bike. I have nothing against helmets I think they save lives for sure and I wear one when I skate, but if this is really a free country and I believe if I want to take the chance of splitting my head open on the concrete because I like the wind in my hair when I bike, I should have that right, I mean I am the one that foots the medical bill if I do right. Its not like our gorvenment provides healthcare for the citizens if they did I would understand laws to "protect me" from my own stupidity, but if I'm paying then it should be my choice. One cop in downtown seattle actually told me that they didn't want to have to scrape me of the concrete after I had pulled over come to a controlled stop with a foot brake from about 40mph, when in fact the ambulance guys or people from the morge do that. I'm a grown man I think I know what I can handle.
I didn't me to go off on a rant and I understand that freedom differs from state to state, I just wish people here didn't enjoy controling others and sticking there noses where they don't belong. My point, as long as I am not holding up or causing traffic, causing wrecks, not making too much noise or grinding up curbs and riding my skate when the roads are other wise empty and not being used, as they are in the late evening where is the harm. I don't see why it matters if I skate safely. Regardless I will skate. I live a place with lots of hills and lots of houses and apartments, A playground for a longboarder. People here call the cops a lot but since I live so close I can always take one of the four secret ways back home and hide in shadows when I see the cops coming, then drop off the board and walk the block and watch as they look for me and then leave empty handed...while I laugh ;^). Maybe one day the people and the cops here will realize that I am never gonna stop bombin these hills and there wasting there time calling and coming up here, Its been 3&1/2 years totally unscathed. knock on wood skateboards
